  • Appeal

  • An appeal can be made to the Commission Nationale d'Equipement Commercial by :
    • the Prefect

    • 2 members of the commission départementale

    • the petitioner in case his/her request is rejected by the CDEC.
    The file will then be reexamined by the services of the National Commission and will go before a commission composed of 8 people:
    4 senior officials representing :
    • the Conseil d'Etat (Council of State)

    • the Cour des Comptes (Auditor General)

    • the Inspection Générale des Finances (Financial Monitoring Department)

    • the Inspection Générale de l'Equipement (Road and Building Construction Monitoring Department)
    4 members of the civil society chosen for their experience in the following fields :
    • Distribution

    • Consumption

    • Town and country planning

    • Employment
    The National Commission will issue a decision within the 4 months following the date of appeal.
    As far as cinemas are concerned, the appeal against a decision made by the Commission Départementale d'Equipement Cinématographique can be submitted to the Commission Nationale d'Equipement Cinématographique whose secretariat is hosted by the Centre National de la Cinématographie.
