  • Real-estate projects exceeding certain thresholds are subject to a public enquiry (law of 12 July 1983) and an environmental impact study (decree No. 77-1141 of 12 October 1977 in application of article 2 of the law of 10 July 1976 concerning the preservation of nature).

    Projects leading to the creation of a shop or group of shops with a sales area exceeding 6000 square metres are subject to a public enquiry.

    The public enquiry concerns the economic, social and planning aspects of the project; the CDEC file then becomes public and the investigating commissioner in charge of the enquiry submits his/her findings with regard to the file after having collected the opinions of all people involved in the project through public meetings.

    The following projects are subject to an environmental impact study and a public enquiry prior to the submission of a planning permission (decree No. 77-1141 of 12 October 1977 in application of article 2 of the law of 12 July 1976 concerning the preservation of nature) : projects comprising the creation of a SHON (Surfa
    ce Hors Oeuvre Nette - Net Habitable Space) exceeding 5000 square metres in a district that hasn't implemented a Plan d'Occupation des Sols (POS - Land Development Plan) or, since the SRU law has come into force, a Plan Local d'Urbanisme (PLU - Town Planning Scheme), or comprising the construction of a commercial SHON exceeding 10,000 square metres in towns having implemented a POS or PLU.
