  • Under the law of 5 July 1996, a permission is required for the following projects :
    • The creation of a shop with a sales area exceeding 300 square metres


    • The expansion of the sales area of a shop currently exceeding 300 square metres or that will exceed this size once the project has been carried out.


    • The creation or expansion of a group of adjacent shops or shops sharing the same parking lot (forming a commercial area) with a combined sales area of over 300 square metres or that will exceed this size once the project has been carried out.


    • The creation or expansion of any petrol station attached to a shop.


    • The reuse as a shop of an area exceeding 300 square metres made available following a permission to create a new shop by transfer of activity.


    • The reopening to the public of a store with a sales area exceeding 300 square metres having ceased all commercial activity for more than 2 years.


    • The change of activity sector of an existing shop with a sales area exceeding 2000 square metres (or 300 square metres if the new activity mostly concerns the selling of foodstuffs).


    • The grouping of adjoining shops leading to the creation of a new shop with a total sales area exceeding 1000 square metres (or 300 square metres if the new activity mostly concerns the selling of foodstuffs).
  • A significant change (concerning the sales area or the nature of the activities requested) in a commercial area creation project being examined by the commission or approved by the commission but not yet open to the public.
